3. Account Tiers and Usage Limits

1. Linkwizz offers three account tiers: Free, Personal, and Enterprise.

3. Usage limits, including the number of links that can be shortened per month, vary by plan and are subject to change.

4. Data Collection and Analytics

1. Linkwizz collects data on visitors redirected from our subdomains (e.g., wizz.ws).

2. Data is collected both on the front-end and back-end using Google Analytics and our local data analytics system.

3. By using our Service, you consent to this data collection for the purposes of providing and improving our Service.

5. Privacy and Security

1. All data stored in our database is encrypted.

2. We implement various security measures to protect our database and backend access.

3. Two-factor authentication (2FA) is available for user accounts.

4. We provide email alerts for logins from unknown locations or devices.

6. Prohibited Uses

The following uses of our Service are strictly prohibited:

7. Reporting Abuse

1. Users can report potentially abusive or inappropriate links at linkwizz.co/report.

2. We will review reported links and make a determination within 24-48 hours.

8. Account Termination

1. We reserve the right to terminate accounts that violate these Terms of Usage.

2. Specifically, we may terminate accounts and ban user IPs if we detect:

   • Malicious use of our Service

   • Attempts to circumvent usage limits by creating multiple accounts

3. Inactive user accounts may be deleted after a period of inactivity. All associated data will be deleted upon account removal.

9. Service Guarantees

1. In the event that Linkwizz permanently ceases operations, we guarantee that all links, QR codes, and bio-links will continue to function for 3 months following the announcement of closure.

2. Beyond this guarantee, the Service is provided "as is" without any further warranties, express or implied.

10. Intellectual Property

1. Linkwizz and its original content, features, and functionality are owned by Linkwizz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

2. Users retain all ownership rights to the content they shorten links for or include in their bio-link pages.

3. By using our Service, you grant Linkwizz a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing and improving the Service.

4. Use of the Linkwizz brand name, logo, or other trademarks is subject to regular copyright laws. Unauthorized use is prohibited.

11. API Usage

1. API access is available for Enterprise accounts with a rate limit of 5 requests per second.

2. Developers requiring higher API rate limits must contact Linkwizz directly for a developer account.

3. We reserve the right to modify, suspend, or terminate API access for any reason, with or without notice.

12. Copyright Infringement and DMCA

1. Linkwizz respects the intellectual property rights of others and expects users to do the same.

2. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

3. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the information.

4. Linkwizz will follow and implement decisions made in response to DMCA requests.

13. User-Generated Content

1. Users are solely responsible for the content they create and share through our Service.

2. Bio-link pages containing sensitive content must be appropriately marked by toggling the sensitive content option.

3. We reserve the right to remove any content that violates these Terms of Usage or is otherwise objectionable.

14. Link Expiration and Data Retention

1. Shortened links do not expire and will remain active as long as the associated account is active.

2. In the event of account deletion due to inactivity or violation of terms, all associated data, including shortened links, will be deleted.

15. Account and Link Ownership

1. Users may transfer ownership of shortened links or entire accounts to other users.

2. The process and any restrictions for transfers will be outlined in our help documentation.

3. Linkwizz is not responsible for any disputes arising from ownership transfers.

16. Geographic Restrictions

1. Currently, Linkwizz does not impose geographic restrictions on the use of our Service.

2. We reserve the right to block access from certain countries or regions in response to detected spam, government bans, or other legal requirements.

17. Dispute Resolution

1. In disputes between users regarding username handles or similar issues, priority will be given based on the following criteria:

   1. Official government documents or trademark registrations

   2. First user to register the username or similar identifier

2. Linkwizz reserves the right to make final decisions in any disputes.

18. Bulk Link Creation and High-Volume Usage

1. Users may create bulk links according to their plan limits.

2. During high server load times (not pre-determined), bulk operations may need to be rescheduled or performed in parts.

3. We reserve the right to temporarily limit bulk operations to maintain service stability.

19. Refunds

1. If Linkwizz is unable to provide the services outlined in a paid plan, we agree to issue a refund for the affected period.

2. Refund requests will be evaluated on a case-by-case basis.

20. Third-Party Integrations

1. Linkwizz offers integrations with third-party services, including but not limited to Slack and Zapier.

2. Use of these integrations is subject to the respective terms and conditions of the third-party services.

3. Linkwizz is not responsible for the functionality or content of third-party services.

21. Changes to Service Features or Pricing

1. Linkwizz may add new features to the Service at any time.

2. We commit to not removing features or reducing usage limits for existing plans.

3. Any changes to pricing or plan structures will be communicated to users in advance.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Linkwizz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

1. Your use or inability to use the Service.

2. Any unauthorized access to or use of our servers and/or any personal information stored therein.

3. Any interruption or cessation of transmission to or from the Service.

4. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.

23. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law provisions.

24. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

25. Security and Limitation of Liability

1. While Linkwizz implements industry-standard security measures to protect our servers and control panel, we cannot guarantee absolute security.

2. In the event of a security breach or hack of our servers or control panel:

   1. Linkwizz will notify affected users as soon as reasonably possible.

   2. We will take all reasonable steps to mitigate the impact and prevent future occurrences.

3. Linkwizz shall not be held liable for any damages, losses, or consequences resulting from unauthorized access to our servers or control panel, including but not limited to:

   1. Loss or theft of data

   2. Misuse of user information

   3. Service interruptions or downtime

   4. Any financial or reputational damages incurred by users

4. Users are responsible for maintaining the security of their own account credentials and should notify Linkwizz immediately of any suspected unauthorized access to their account.

26. Payment Processing and Data Storage

1. Linkwizz uses third-party payment processors, including but not limited to Lemon Squeezy and Stripe, to handle all payment transactions.

2. Linkwizz does not store, process, or have access to users' credit card information or other sensitive payment data.

3. All payment information is collected, stored, and processed directly by our third-party payment processors.

4. The use of these payment processing services is subject to their respective terms of service and privacy policies:

5. Linkwizz is not responsible for the security of payment information handled by these third-party processors.

6. Any disputes or issues related to payment processing should be directed to the relevant payment processor.
